ADA Policy Specialist and Trainer - independent contractor position

Preference is for an attorney with extensive ADA policy understanding / background.
California resident is preferred.

As this is an independent contractor position, tasks assigned will be project-based with a flat fee to be negotiated in advance per assignment.

Job title: ADA Policy Specialist and Trainer

Job functions include:
The candidate must be well-versed with the ADA and perform associated tasks related to the preparation of ADA Self-Evaluation and ADA implementation programs, including, but not limited to:
•Development of questionnaires/tools to evaluate each public agency client’s policies, procedures and practices
•Analyze/evaluate client responses to prepare detailed reports of findings and recommendations
•Develop new policies and/or update existing policies to ensure compliance with applicable laws
•Conducting training on ADA technical issues and disability awareness
•Conducting training on accessible meeting production and auxiliary aids/services provision for meeting planners
•Conduct training for maintenance personnel and janitorial staff to understand their role in creating/maintain an accessible environment
•Conduct training for first responders and disaster planners on emergency management for persons with disabilities
•Analysis of the “Essential Functions” in job descriptions
•Development of Reasonable Accommodation policies
•Provide guidance/analysis on undue hardship/direct threat
•ADA/FMLA/Worker's Compensation & California disability employment law

The candidate will focus on counseling and advising clients on ADA and EEO compliance issues and other workplace laws pertaining to persons with disabilities.
Will represent clients during investigations, audits, and other enforcement activities by local, state and federal government agencies, including those involving large-scale class allegations.

Demonstrated expertise in ADA and EEOC compliance and administrative procedure and will assist clients in resolving highly-sensitive and novel issues before these agencies.
Candidate’s responsibilities include developing guidance documents pertaining to the following policies, procedures and practices:

•Grievance system used to address Disability civil rights complaint
•Dissemination system for ADA Notice of Compliance
•Service Animal Policy
•Employee Reasonable Accommodation Policy (Based upon California Gov. Code 12926)
•Anti-Surcharge Policy
•Policy and procedure for policy-modification requests and the determination of undue burden
•Procedure for accessible ticket sales
•Policy regarding the use of personalized motorized vehicles in public areas
•Policy and procedure for determining direct threat
•Language used in contracts to prohibit disability discrimination
•Policy regarding the maintenance of accessible features

Help clients proactively manage a variety of Title I employment matters pertaining to the ADA, FLSA, GINA and other federal regulations/laws.

Will advise clients on the provision of reasonable accommodation under disability laws and achieving compliance with applicable state leave laws.

Demonstrated experience as a trainer and a fluent speaker on Disability Employment Laws covering State and Federal mandates for HR staff and supervisors.

Provides clients with policy-guidance and employee training services, and helps clients keep abreast of changes in state and federal law.
